P(A)T SIGNS THE PROTOCOL FOR THE PROTECTION OF THE RIGHTS OF VICTIMS OF TRAFFIC ACCIDENTS

On May 3 at the headquarters of the Specialized Units of the State Attorney General’s Office, Vicente Sánchez, president of P(A)T, along with other associations, insurance entities and the Prosecutor’s Office, signed the protocol aimed at providing greater protection to the rights and interests of victims in the judicial procedure.

The purpose of the Protocol is to establish cooperation mechanisms and agile communication channels between the parties.

Thus, the signatory parties of the Protocol want to promote the following objectives:

  1. The promotion of the extrajudicial solution of discrepancies, taking into account the necessary judicial authorization when dealing with minors and people with disabilities for whom this has been judicially ordered.
  2. The simplification and speed of civil and criminal judicial procedures on traffic accidents with harmful results, promoting a prompt resolution by the jurisdictional bodies, and the satisfaction of civil responsibilities in accordance with the procedure cited in the previous section.
  3. Information and instruction on the rights and benefits of all kinds to which victims of traffic accidents are entitled, in accordance with Directive 2012/29/EU of 25-10 and corresponding provisions of national legislation (arts. 4-26 EVD) in order to achieve immediate assistance and attention to your needs in different areas without unjustified delays. All of this in coordination with the Victim Assistance Offices (arts. 27-29 EVD) and with the Victims’ Associations and other signatory associations.
  4. The provision to victims of prompt, effective and continuous care and information, presided over by criteria of humanitarianism, ensuring that they are “forgotten” from occurring. For these purposes, as well as social “awareness” in favor of the victims included in art. 34 EVD, within the scope of their respective functions, the promotion and/or participation in events and/or personal meetings with victims will be encouraged, as well as the development and/or participation in operational and coordinated protocols, in which they may also Participate other parties that are legally entrusted with the protection and defense of the interests of victims (Traffic Police, Victim Assistance Offices, etc.)
  5. The detection of certain abusive behaviors or forms of fraud against insurance entities or the Insurance Compensation Consortium, seeking maximum transparency and observance of the law in the economic-care circuit that must be aimed at their protection.
